1. Promoter

These General Giveaway and Contest Terms ("General Terms") apply to promotions operated by:

Burnsies Hideout is referred to in these General Terms as the "Promoter", "we", "us" or "our".

All promotion enquiries, verification, complaints and privacy requests are handled through the official Discord server. We do not operate a public support email address for promotions.

2. Application of These Terms

These General Terms apply to every giveaway, prize draw and skill-based contest operated by the Promoter through our website, Discord server or another identified platform.

Every promotion will also have a promotion page containing its specific details ("Promotion Schedule"). The blank template is published at Mandatory Promotion Schedule.

The General Terms and applicable Promotion Schedule together form the complete official rules for that promotion ("Official Rules").

By entering, an entrant confirms that they:

  1. have read and understood the Official Rules;
  2. agree to comply with the Official Rules;
  3. satisfy all eligibility requirements; and
  4. consent to the use of their information for administering the promotion as described in these terms.

If the Promotion Schedule conflicts with these General Terms, the Promotion Schedule will apply to that promotion, except where doing so would remove a right that cannot lawfully be excluded.

3. Promotion Types

Each Promotion Schedule must identify the promotion as one of the following.

3.1 Random Giveaway

In a Random Giveaway, winners are chosen randomly from all verified eligible entries.

An entrant may be required to meet an objective activity threshold before becoming eligible. Once the threshold is met, additional activity will not increase the entrant's chance of winning unless the Promotion Schedule clearly provides lawful bonus entries.

Staff preference, popularity, friendship, purchases, donations or subjective opinions will not influence a random draw.

3.2 Skill-Based Contest

In a Skill-Based Contest, entries are evaluated using the judging criteria and weightings published in the Promotion Schedule.

The Promotion Schedule must state:

  • what entrants must submit;
  • all judging criteria;
  • the weighting of each criterion;
  • who will judge the entries;
  • the judging date;
  • how ties will be resolved; and
  • whether any finalist or public-voting stage applies.

A simple question or minor task will not be represented as a skill contest where the winner is ultimately chosen randomly.

3.3 No Undisclosed Selection Method

We will not change a Random Giveaway into a Skill-Based Contest, or vice versa, after entries have opened.

Any multi-stage selection process must be clearly described before entry opens.

4. Promotion Schedule Required

A promotion must not open until its Promotion Schedule has been completed and published.

The Promotion Schedule must state:

  1. the promotion name;
  2. the Promoter's identity;
  3. the promotion type;
  4. the opening and closing dates and times;
  5. the applicable time zone;
  6. eligible countries, states, provinces or territories;
  7. excluded locations;
  8. the minimum age;
  9. the free entry method;
  10. the entry limit;
  11. any activity requirement;
  12. the number and description of prizes;
  13. the retail value of each prize;
  14. the total prize pool;
  15. material platform, device or regional restrictions;
  16. the winner-selection method;
  17. the draw or judging date;
  18. the winner-notification method;
  19. the claim deadline;
  20. the replacement-winner process;
  21. the expected delivery period;
  22. where results will be published;
  23. any required permit, licence or authority number; and
  24. any additional material condition.

Advertising may summarise a promotion, but it must provide a clear link to the complete Official Rules.

5. Eligible Locations

A promotion is only open in countries, states, provinces and territories expressly identified as eligible in the Promotion Schedule.

The phrase "worldwide where legal" means participation is permitted only where:

  • the promotion is lawful;
  • the Promoter has completed any required compliance review;
  • all required permits, licences, registrations, bonds, filings and approvals have been obtained;
  • the prize may lawfully be provided;
  • the prize can be delivered or redeemed;
  • participation does not breach sanctions, export controls or trade restrictions; and
  • the Promotion Schedule does not exclude the location.

A general statement that a promotion is "void where prohibited" does not replace the Promoter's obligation to identify and comply with applicable laws.

The Promoter may exclude a location before entries open where its legal, registration, tax, language, delivery or administrative requirements have not been satisfied.

An entrant must not use a false address, virtual private network, proxy or other method to misrepresent their location.

6. Age Requirement

Unless a Promotion Schedule sets a higher age, entrants must:

  • be at least 18 years old; and
  • have reached the legal age of majority in their place of residence.

The Promoter may request reasonable evidence of age before awarding a prize.

Promotions involving age-restricted products, services, games or content will have additional eligibility restrictions and will not be offered where prohibited.

7. General Eligibility

An entrant must:

  1. be a natural person;
  2. live in an eligible location;
  3. enter during the Promotion Period;
  4. use an account that belongs to them;
  5. provide accurate information;
  6. satisfy every entry requirement;
  7. comply with relevant website, community and platform rules;
  8. be legally permitted to enter and receive the prize; and
  9. be able to use or redeem the prize as described.

Unless the Promotion Schedule expressly states otherwise, the following people cannot enter:

  • the Promoter's owners, officers or employees;
  • contractors involved in administering the promotion;
  • moderators or administrators responsible for verifying entries;
  • judges;
  • people involved in drawing winners;
  • prize suppliers directly involved in administering the promotion; and
  • members of the immediate household of any of the above.

8. No Purchase Necessary

No purchase, payment, donation, paid subscription, premium membership, Discord Nitro boost, server boost or other contribution of money or monetary value is required to enter or win.

A purchase or payment will not improve an entrant's chance of winning.

We will not require a winner to pay:

  • a claim fee;
  • an administration fee;
  • an undisclosed delivery fee;
  • cryptocurrency;
  • gift cards; or
  • any other payment to receive a prize.

Normal internet or data charges imposed by an entrant's provider may apply.

9. Promotion Period

The opening and closing dates, times and time zone will be stated in the Promotion Schedule.

Unless stated otherwise, dates and times are in Australian Eastern Standard Time — AEST, UTC+10.

Entries submitted before the opening time or after the closing time are invalid.

Our website and platform records will be used to determine the submission time, subject to correction where there is evidence of a material technical error.

10. Entry Methods

Entrants must follow the entry steps stated in the Promotion Schedule.

Entry methods may include:

  • submitting a website form;
  • reacting to a Discord announcement;
  • joining or remaining in an identified community;
  • submitting a Discord user ID;
  • completing a free activity requirement;
  • answering a question;
  • submitting original content; or
  • another lawful free method.

Unless otherwise stated, each person may submit one entry per promotion.

A person may not obtain additional entries by using:

  • alternate accounts;
  • duplicate identities;
  • disposable contact details;
  • another person's account;
  • bots;
  • scripts;
  • macros;
  • automated entry tools; or
  • fraudulent information.

We may remove accidental duplicate submissions without disqualifying an entrant where doing so is fair.

11. Discord and Community Activity Requirements

Some promotions may require genuine community participation.

The Promotion Schedule must state:

  1. the server or community in which activity must occur;
  2. the relevant channels;
  3. the activity period;
  4. the minimum number of qualifying messages or actions;
  5. how activity will be counted;
  6. when eligibility will be measured;
  7. any excluded channels; and
  8. the review process for disputed results.

11.1 Qualifying Messages

A Qualifying Message must:

  • be posted by the entrant;
  • be original or genuinely written for the conversation;
  • be relevant to the channel or discussion;
  • make a genuine contribution;
  • comply with the Community Rules; and
  • remain visible when eligibility is checked, unless it was removed by moderators through no fault of the entrant.

A short message may qualify where it genuinely contributes to the conversation.

11.2 Non-Qualifying Activity

The following activity does not qualify:

  • spam;
  • repeated or substantially identical messages;
  • copied messages;
  • meaningless text or random character strings;
  • messages posted by bots or automated tools;
  • deliberate splitting of one message into multiple messages;
  • repeated emojis or reactions without genuine discussion;
  • unsolicited advertising;
  • messages posted in excluded channels;
  • messages that violate community rules;
  • harassment;
  • activity generated primarily to manipulate the promotion; or
  • messages deleted by the entrant before verification.

The Promoter must apply these criteria consistently and must not reject activity merely because a moderator dislikes the entrant or disagrees with a lawful opinion.

11.3 Effect on Random Draws

For a Random Giveaway, community activity is an eligibility threshold only.

Unless lawful bonus entries are specifically described in the Promotion Schedule:

  • an entrant who completes the minimum requirement receives one valid entry;
  • sending more messages does not provide better odds; and
  • staff may not subjectively select the "most active" entrant as the winner.

11.4 Verification and Review

We may use website records, platform logs, moderation records and reasonable automated tools to verify activity.

An entrant who believes their activity was counted incorrectly may contact us within the period stated in the Promotion Schedule. We will conduct a reasonable manual review before the draw where practicable.

12. Entry Content

Where a promotion requires text, artwork, photographs, videos, screenshots, recordings or other content, the entrant confirms that:

  • the entry is their original work or they possess all necessary permissions;
  • it does not infringe copyright, trademark, privacy, publicity or other rights;
  • it does not contain unlawful, defamatory, threatening, hateful or explicit material;
  • it does not disclose another person's private information without permission;
  • it does not contain malware or deceptive links; and
  • it complies with applicable platform rules.

The entrant retains ownership of their content.

The entrant grants the Promoter a non-exclusive, worldwide, royalty-free licence to store, reproduce and display the entry only as reasonably required to:

  • administer the promotion;
  • verify and judge the entry;
  • announce the results;
  • display winning entries; and
  • maintain legally required records.

We must obtain separate permission for materially different commercial use unless that use was clearly disclosed before entry.

13. Random Draws

For a Random Giveaway:

  1. the draw will occur on or about the date in the Promotion Schedule;
  2. all eligible entries will be verified before or immediately after selection;
  3. winners will be selected using a computerised random-selection tool or another demonstrably random method;
  4. each eligible entry will have an equal chance unless lawful bonus entries were disclosed;
  5. a person conducting or supervising the draw cannot enter;
  6. the draw will be independently witnessed or scrutinised where required by law; and
  7. reasonable records of the draw will be retained.

The odds of winning depend on the total number of eligible entries.

A person does not need to be present during the draw unless the Promotion Schedule lawfully and prominently states otherwise.

14. Skill-Based Judging

For a Skill-Based Contest:

  • judges will evaluate eligible entries against the published criteria;
  • criteria will be applied consistently;
  • purchases, donations and personal relationships will not influence scores;
  • judges must disclose material conflicts of interest;
  • the highest-scoring eligible entry or entries will win;
  • ties will be resolved using the published tie-breaker; and
  • judging records may be retained for verification.

A public vote will only be used where the voting process, fraud controls and effect on final selection are clearly stated.

15. Prizes

The Promotion Schedule must accurately identify:

  • the prize;
  • its quantity;
  • the applicable model, version or edition;
  • whether it is new, refurbished or used;
  • the approximate retail value and currency;
  • any expiry date;
  • any age restriction;
  • any platform or regional restriction;
  • delivery limitations;
  • included and excluded costs; and
  • material conditions of use.

Prize images are illustrative unless the Promotion Schedule identifies the exact pictured item.

We will not knowingly advertise a prize that we do not possess, have not secured or do not reasonably expect to be able to supply.

Prizes cannot be exchanged for cash or another product unless the Promotion Schedule provides an alternative or the parties lawfully agree to a replacement.

16. Prohibited or Restricted Prizes

Unless separately reviewed and lawfully authorised, we will not offer:

  • firearms, ammunition or prohibited weapons;
  • explosives;
  • illegal drugs;
  • prescription-only medicine;
  • tobacco or nicotine products;
  • alcohol;
  • dangerous chemicals;
  • counterfeit or stolen goods;
  • illegal gambling services;
  • financial investments or credit products;
  • adult sexual products;
  • live animals;
  • unlawfully obtained digital goods; or
  • anything unlawful to advertise, possess, deliver or award.

Additional age, licensing, delivery and geographic conditions may apply to legally restricted products.

17. Digital Games, Software and Codes

Where a prize is a digital game, gift card, software licence, subscription or redemption code:

  1. the prize must be lawfully obtained;
  2. the code must be unused when delivered;
  3. the winner must redeem it through their own eligible account;
  4. the required platform, storefront, device and region must be disclosed;
  5. known expiry dates and subscription conditions must be disclosed;
  6. third-party terms may apply;
  7. we will not provide or transfer another person's account;
  8. we will not provide account credentials;
  9. we will not request the winner's password or authentication code; and
  10. proof of lawful acquisition will be retained where reasonably necessary.

If a code is confirmed to have been redeemed before confirmed delivery to the winner, we will provide a replacement or reasonably equivalent prize.

We are not responsible where a winner:

  • attempts redemption in an incompatible region;
  • uses an unsupported device;
  • provides an ineligible or banned account;
  • discloses the code publicly;
  • loses the code after confirmed delivery; or
  • fails to meet a restriction clearly disclosed before entry.

This does not limit rights that cannot legally be excluded.

18. Physical Prizes

A physical prize will only be delivered to eligible locations stated in the Promotion Schedule.

The winner must provide accurate delivery information by the claim deadline.

The Promotion Schedule must state whether the Promoter or winner is responsible for:

  • shipping;
  • insurance;
  • customs duties;
  • import taxes;
  • brokerage fees; and
  • other government charges.

No undisclosed delivery or handling fee will be imposed by the Promoter.

We will use reasonable measures appropriate to the prize's value, which may include tracked delivery, insurance or signature confirmation.

19. Prize Substitution

We will provide prizes as advertised.

A prize may only be substituted where:

  • the advertised prize becomes unavailable for reasons outside our reasonable control;
  • substitution is lawful;
  • any required regulator approval is obtained; and
  • the replacement is reasonably comparable and has an equal or greater retail value.

We will not substitute a prize merely to reduce our cost or avoid our obligations.

Where appropriate, the winner and Promoter may agree in writing to a different prize.

20. Winner Notification

Potential winners will be contacted using the method stated in the Promotion Schedule.

Official contact will only come from a moderator or administrator inside the official Burnsies Hideout Discord server, from an account carrying a visible staff role in that server. The Promotion Schedule will identify the specific account used for that promotion.

We will never contact a winner from another platform, another Discord server or an account that is not a listed staff account. If you are unsure whether a message is genuine, verify it in the official server before responding.

We will not request:

  • passwords;
  • authentication codes;
  • recovery codes;
  • complete payment-card details;
  • cryptocurrency;
  • gift cards; or
  • a payment to claim a prize.

Unless the Promotion Schedule provides a longer period, a potential winner will have 14 calendar days from written notification to respond and complete reasonable verification.

We will make reasonable attempts to contact a potential winner.

21. Winner Verification

Before awarding a prize, we may request information reasonably necessary to verify:

  • identity;
  • age;
  • country or region of residence;
  • account ownership;
  • entry compliance;
  • activity requirements;
  • authorship of a submitted entry; and
  • legal eligibility to receive the prize.

We will not collect more information than reasonably necessary.

A potential winner may be disqualified where they:

  • are ineligible;
  • did not validly enter;
  • provide materially false information;
  • use prohibited automation or multiple accounts;
  • manipulate the promotion;
  • fail to provide reasonable verification;
  • materially breach the Official Rules; or
  • cannot lawfully receive the prize.

Verification decisions will be evidence-based and applied consistently.

22. Unclaimed Prizes and Replacement Winners

Where a potential winner:

  • does not respond by the claim deadline;
  • refuses the prize;
  • is disqualified;
  • cannot be verified; or
  • cannot lawfully receive the prize,

a replacement winner may be selected, subject to applicable law.

For a Random Giveaway, the replacement will be selected through another random draw from the remaining eligible entries.

For a Skill-Based Contest, the replacement will ordinarily be the next-highest-scoring eligible entry.

The replacement date and process must be stated in the Promotion Schedule.

Any required approval for an unclaimed-prize draw must be obtained before it occurs.

23. Publication of Results

Winner details will be published where and to the extent required by law or stated in the Promotion Schedule.

Unless additional disclosure is legally required, publication may be limited to:

  • website or platform username;
  • first name and surname initial;
  • general state, province or country; and
  • winning submission, where applicable.

We will not publish a winner's home address, personal email address, phone number or other unnecessary private information.

24. Prize Delivery

The Promotion Schedule must state the expected delivery period.

We will provide the prize within the stated period or, where no period is stated, within a reasonable period.

Where delivery is delayed, we will provide the winner with a reasonable update.

A prize will not be considered delivered until there is reasonable evidence that:

  • a digital code or gift was sent to the verified contact address; or
  • a physical prize was delivered or made available for collection as agreed.

25. Taxes and Government Charges

Winners are responsible for personal tax, declaration and reporting obligations arising from receipt of a prize, except where the Promoter is legally required to withhold, report or pay an amount.

Any material customs, import or government charges expected to be payable by the winner must be disclosed in the Promotion Schedule.

We do not provide tax advice.

26. Privacy

Personal information collected for a promotion is handled in accordance with these Official Rules, the collection notice displayed when the information is collected, and applicable privacy and data-protection laws.

Information may be used to:

  • process entries;
  • verify eligibility;
  • detect fraud;
  • administer draws or judging;
  • contact winners;
  • deliver prizes;
  • respond to complaints;
  • satisfy regulatory requirements; and
  • maintain legally required records.

Information may be disclosed where reasonably necessary to:

  • website and hosting providers;
  • entry-management providers;
  • random-draw providers;
  • couriers;
  • prize suppliers;
  • professional advisers;
  • payment or fraud-prevention providers; and
  • government regulators.

We will only retain personal information for as long as reasonably necessary for these purposes or as required by law. Information that is no longer required will be securely deleted or anonymised where appropriate.

Requests for access, correction or deletion, and privacy complaints, may be raised through the official Burnsies Hideout Discord server, subject to applicable law.

27. Marketing Communications

Entry into a promotion does not automatically subscribe an entrant to marketing.

Any marketing consent must be:

  • separate from acceptance of the Official Rules;
  • optional;
  • clearly explained;
  • unticked by default; and
  • capable of being withdrawn.

Promotional messages will identify the sender and include a functional unsubscribe method where required.

Withdrawing marketing consent will not invalidate an otherwise eligible giveaway entry.

Administrative messages concerning an entry, winner verification or prize delivery are not marketing messages unless they also contain promotional content.

28. Third-Party Platforms

A promotion may be advertised or administered using Discord, Microsoft, Rockstar Games, Steam, Epic Games, LCPDFR.com, Twitch, YouTube, X, Instagram, Facebook or another third-party platform.

Unless expressly stated otherwise:

  • the promotion is not sponsored, endorsed, administered by or associated with the third-party platform;
  • the Promoter is solely responsible for administering the promotion;
  • entrants must comply with applicable platform terms;
  • platform names and trademarks belong to their respective owners; and
  • questions about the promotion must be directed to the Promoter.

Nothing in these terms requires a third-party platform to provide support or replace a prize.

29. Prohibited Conduct

Entrants must not:

  • use bots, scripts, macros or automated tools;
  • use alternate or duplicate accounts;
  • impersonate another person;
  • buy, sell or transfer entries;
  • manipulate message or activity records;
  • coordinate fraudulent entries;
  • interfere with another entrant;
  • exploit a technical fault;
  • submit malicious software or links;
  • harass staff, judges or participants;
  • falsify identity, age or location information; or
  • otherwise seek an unfair advantage.

Where there is reasonable evidence of serious or repeated abuse, we may:

  • reject affected entries;
  • disqualify the participant;
  • preserve relevant records;
  • report conduct to the relevant platform or authority; and
  • exclude the participant from future promotions.

30. Technical Problems

We are not responsible for an entry that is not received because of:

  • the entrant's internet failure;
  • an incompatible device;
  • incorrect account settings;
  • inaccurate contact information;
  • an entrant's failure to follow instructions; or
  • a third-party outage outside our reasonable control.

Where a material system failure affects fairness, we may take a reasonable corrective action, including:

  • extending the closing date;
  • restoring verified entries;
  • repeating an affected draw;
  • providing an alternative entry method; or
  • temporarily suspending entries.

No entrant will be disqualified solely because of a verified error caused by our system.

31. Changes, Suspension and Cancellation

We may modify, suspend or cancel a promotion only where reasonably necessary because of:

  • fraud or manipulation;
  • a serious security incident;
  • a material technical failure;
  • a regulator's direction;
  • a change in law;
  • genuine prize unavailability outside our reasonable control;
  • closure or failure of a required platform;
  • natural disaster;
  • war or civil emergency; or
  • another event that makes lawful and fair administration impossible.

We will not materially change entry requirements, judging criteria or prize values after entries open merely to disadvantage entrants or avoid awarding a prize.

Any change will:

  • comply with applicable law;
  • receive regulator approval where required;
  • preserve fairness as far as reasonably possible; and
  • be announced in the same location as the original promotion.

Cancellation does not automatically remove an entrant's accrued rights.

32. Fair Administration

We will administer promotions honestly, fairly and consistently.

We will not:

  • advertise a prize we do not intend to provide;
  • predetermine a winner while representing that selection is random;
  • secretly favour staff, friends, donors or customers;
  • impose an undisclosed payment;
  • exaggerate the prize or odds of winning;
  • change judging criteria after reviewing entries;
  • invent a breach to avoid awarding a prize; or
  • withhold a validly won prize without a legitimate legal reason.

33. Consumer Rights and Liability

Nothing in the Official Rules excludes, restricts or modifies:

  • a consumer guarantee;
  • a statutory right;
  • liability for fraud or wilful misconduct; or
  • any other right or liability that cannot lawfully be excluded.

To the maximum extent permitted by law, we are not responsible for indirect or consequential loss caused by participation in a promotion or use of a prize.

Any limitation of liability will be reduced to the maximum extent necessary to make it lawful and enforceable.

Third-party products and services remain subject to the applicable provider's terms, warranties and consumer-law obligations.

34. Complaints and Reviews

A promotion-related complaint may be raised through the official Burnsies Hideout Discord server, addressed to a moderator or administrator.

The complaint should include:

  • the promotion name;
  • the entrant's username or entry reference;
  • a description of the issue;
  • relevant dates; and
  • supporting evidence.

We will review complaints reasonably and correct clear factual, technical or administrative errors.

A dispute concerning activity eligibility should be raised before the draw wherever reasonably possible.

35. Records

We may maintain records relating to:

  • published rules;
  • advertisements;
  • entries;
  • eligibility checks;
  • activity verification;
  • random draws;
  • judging;
  • winner communications;
  • prize purchase and delivery; and
  • complaints.

Records will be retained for the period required by applicable law and then securely deleted or anonymised where appropriate.

36. Governing Law

These General Terms and promotions operated by the Promoter are governed by the laws of Queensland, Australia, subject to any mandatory law applying in an entrant's place of residence.

The parties submit to the courts of Queensland, Australia, without removing any mandatory right an entrant may have to bring a claim elsewhere.

37. Severability

If a provision is invalid or unenforceable, it will be read down to the minimum extent necessary.

If it cannot be read down, it will be removed without affecting the remaining provisions.

38. Updates to These General Terms

We may update these General Terms for future promotions.

The version in effect when a promotion opens will continue to govern that promotion unless:

  • a change is legally required;
  • a regulator directs otherwise; or
  • a change is necessary to preserve fairness and does not materially disadvantage entrants.

The effective date appears at the beginning of this document.
